You're right, of course.

The legal issues would also go away if Microsoft just stopped selling
software.

Here's a question. What do you believe are the *minimum* concessions that
Microsoft needs to make for the legal issues to go away?

That, I believe, is the question to ask, and the question on which the
Microsoft/DOJ talks broke down. If, for example, Microsoft doesn't believe
that it is legally required to pull features from its OS, then its not going
to make that concession -- or if it does, then it's only to avoid what
essentially is a nuisance lawsuit.
