Ebay does not SELL or BUY anything. They are the Matching Protocal by
which buy and sell agents travers thru. It is clearly stated in the
memberish statement right up front.
Thus ebay would be held no more liable for a bad seell as an ISP is for a
post made by a user on usenet.
