DoD and polymorphic viruses

The WSJ reports today (page B6) that a Pentagon panel of security
experts recommends that the law be changed "to allow the Pentagon to
respond [to hackers] by injecting the attackers' computers with 'a
polymorphic virus that wipes out the system, takes it down for weeks.'"
Why didn't CERT think of that?
