Only if they were captured in Afghanistan without wearing a uniform and
holding an AK-47.
Of course the traditional solution to that problem (of such illegal
combatants), is to hang such people immediately. (You hang them, not
shoot them, shooting is for honorable enemies). Locking them up instead
is a military decision probably justified by the facts on the ground in
Afghanistan. (You would rather they surrender quickly).
These [train] folks were not illegal combatants, just immoral and
stupid. Firing is sufficient. Had the shooting already started then
you probably have grounds for a Treason charge.
