IS (POLITICAL) CHAT-ROOM SPEECH PROTECTED?
The First Amendment is getting a thorough test courtesy of a widely used and
often anonymous tool to express ideas - the online chat-room. The American
Civil Liberties Union and a number of Internet companies have lined up to
protect the identity of a person who alleged in a political online chat room
that a state court judge behaved unethically. If the lawyer acting on
behalf of the state court judge can prove she was harmed by the allegation,
AOL may have to reveal the identity of the person who made the comment, so a
suit can be filed.
