Maybe in this case things were fine.  From personal experience, I can  
say that sometimes US judges are perfectly happy to issue orders  
without knowledge of the affected party, and are in fact even willing  
to preserve this ignorance by issuing ex parte *secret* orders.

The more I get to contrast code with common law jurisdictions, the  
more I realize how common law has an aspect of Winchester Mystery  
Jurisprudence.
