Not sure about this -- I recall that authors (or at least authors'
organizations) were upset by this.  Just as author groups have
actively fought against digitization of copyrighted, but orphaned
books.

Fundamentally, the problem is that publishing is already a shrinking
pie, and there's great resistance to any innovations that will further
cut the pie size, even if it's possible that the pie might get bigger
(or be redistributed) in the future.
